Commissioning Terms for Freelance Articles
Unless agreed otherwise in writing, the following terms apply to contributors engaged by the Publisher (Timingwallstreet, Inc., the owner of WallStreetWindow.com) on an irregular basis as contributors.
1. Commissioning
The Publisher may (but is not obliged to) commission the Contributor to undertake work on its behalf. The Publisher is not under an obligation to accept all works submitted by the Contributor. Once a work is submitted, the Publisher will look over it and may have an editor make small changes to it, such as changing the title, correcting spelling mistakes or types, and making minor grammar edits, before publishing it, with the goal of improving its visibility and the experience of the reader.
2. Production of material
The Contributor shall produce original work of a professional standard. By submitting this material to the Publisher, the Contributor is accepting these commissioning terms.
3. License
The Contributor is the copyright owner of the Commissioned Content. 3.1.
The Contributor grants the Publisher the following worldwide, irrevocable and sub-3.2.licensable rights:
a) the right to reproduce the Commissioned Content in its Publications; and
b) to use, copy, reproduce, store, publish, print, adapt, save and archive the Commissioned Content in its Publications and allow others to do so under a Creative Commons License.
4. Ideas
Any ideas that are submitted by the Contributor may be developed by the Publisher independently.
5. The law that governs a Contributor’s contribution
These terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, the state in which the Publisher is organized as a corporation.
Other information
In these terms the following words and expressions will have the following meanings:
“Publications” means the Publisher’s titles and products in all forms including digital and print clipping service articles, derivative versions and branded and unbranded news services (whether known now or created in the future) in any media and on any platform and/or any magazine or supplement published for the Publisher’s titles from time to time.
“The Publisher” means Timingwallstreet, Inc. whose mailing address is P.O. Box 11658, Danville, VA 24543, and any subsidiary of it and website owned by it, including WallStreetWindow.com.
“Contributed Content” includes any text, files, images, photos, graphics, video, sounds, musical works, or any other materials that the Publisher receives from a Contributor.
